What To Do With Those Holiday Trees

The Johnson County Park and Recreation District will be accepting post-holiday contributions of discarded natural Christmas trees at three locations from December 26th through January 31st.
 
Collection sites are:
 
1) The parking lot at the Theatre in the Park in Shawnee Mission Park, with a separate entrance at 7710 Renner Road, Shawnee;
 
2) The Heritage Park Marina parking lot, 16050 Pflumn Road, Olathe; and,
 
3) The north side of the parking lot at the marina at Kill Creek Park, 11670 Homestead Lane, Olathe.
 
Trees will be collected during regular winter park hours, which are 7:30 a.m. to 8 p.m., except at Shawnee Mission Park, which opens at 6 a.m. in the winter.
 
In 2017, between 4,000 and 5,000 trees were "recycled." Some of the trees will be used for mulch, while others will be used improve fish habitat in district lakes.
 
No yard waste will be accepted - only Christmas trees. There is no charge for the disposal of trees, and this program is open to anyone regardless of residency.

A reminder that the dumping of yard waste, Christmas trees and other debris on Bristol Ridge and Bristol Valley HOA property is prohibited. This includes the retention ponds in Bristol Ridge. Residents in violation are subject to a fine.

Update – Amended and Restated HOA Declarations

Currently, 80 homeowners have approved the proposed changes to the HOA Declarations. We are 47.1% of the way to meeting our goal of exceeding the two-thirds requirement. Please take the time and complete your signature pages and return two signed originals to the HOA.
Why is it critically important to amend and restate the current Declarations? Our demographics have changed. We are a now a multi-generational community. For this reason there is a need to adjust the Declarations so they are fair and reasonable for all homeowners.
 
The current Declarations have been inconsistently enforced by the succession of past developers. This puts in jeopardy the enforcement of any part of the Declarations. The HOA Board of Directors has set January 1, 2019 to begin to enforce consistently the declarations in place as of that date.
 
Below are just some of the clauses that affect most homeowners that we are recommending changing:
 
8. Buildings or Uses Other than For Residential Purposes; Noxious Activities; Miscellaneous
Pages 7 & 8 – (b)
 
DELETED - Each residence exterior shall be repainted by the Owner every five years or less, as needed.
 
CHANGED TO - Each residence exterior shall be repainted by the Owner as needed (or at least whenever determined as necessary by the Architectural Committee).
Pages 7 & 8 – (h)
 
DELETED - No artificial flowers, trees or other vegetation shall be permitted on the exterior of any residence or in the yard. Sculptures, bird baths, fountains, yard art, and similar decorative objects are allowed on the exterior of the residence or in the yard only with the specific written approval of the Approving Party.
 
CHANGED TO - Sculptures, bird baths, fountains, yard art, and similar decorative objects, as well as artificial flowers, trees or other vegetation must be tasteful and appropriate. The Architectural Committee or Board, in its discretion shall always have the right to additionally regulate, prohibit, condition, or otherwise restrict any item in this section notwithstanding such otherwise compliance.

DELETED - Garage doors shall remain closed at all times except when necessary for ingress and egress.

HOA Amended and Restated Legal Documents

Previously, I sent you information about signature pages you will be receiving from the HOA regarding Amended and Restated legal documents.  The signatures pages went in the mail today, so please look for them in your mail.  Your notarized signature(s) is required to indicate your approval to implement the Amended and Restated HOA Declaration and the HOA Declaration of Restrictions.  It is important that you return the original signed signature pages to the HOA address, 21315 W 82nd Street, Lenexa, KS 66220.  The State of Kansas will not accept a copy.

 The Amended and Restated documents compile all the previous legal documents and amendments into the two documents, eliminates information no longer needed, and complies with current laws.  The Amended and Restated legal documents, and summary of some of the important changes can be found on this website's Home Page under Documents and BRBV Legal Documents.

 Our goal is to have these returned as soon as possible, so that we can file them with the State of Kansas and be ready to implement by January 1, 2019.

 If any of our residents are notaries and would be willing to volunteer some time, we would greatly appreciate it.
